"WAKE UP AND WIN" OFFICIAL CONTEST RULES

1. No purchase is necessary to enter. To participate in the contest, watch KTKA Morning News Update between 6:00am and 7:00am Monday through Friday for your chance to win. Each morning KTKA 49 ABC will broadcast a Wake Up and Win announcement during the above referenced newscasts, if you are the first to call in you win! You will have two KTKA business days to claim your prize at the KTKA Studios located at 2121 SW Chelsea Drive Topeka, Kansas. You must bring two forms of legal identification to verify your date of birth.

2. Contest period. The duration of the contest is from Monday December 29th , 2008 through Friday December 25th , 2009.

3. Prizes. There will be one prize awarded per newscast. The approximate retail value of this prize is $10.00. Contest sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion.

4. Limitations.

(a) Void where prohibited. You must reside in KTKA 49 ABC's viewing area and be at least 18 years of age to enter.

(b) Your entry constitutes your permission (except where prohibited by law) to use your name, city, state, likeness, image, and voice for purposes of advertising, promotion, and publicity without additional compensation.

(c) Viewers are eligible to win a KTKA 49 ABC contest only once every 60 days. Only one winner per household is permitted in any contest. Viewers are eligible to win a prize valued at $600.00 or more only once every six months.

(d) Only one entry per person for the duration of the contest period. Multiple entries received from any person or email address beyond this limit will void any additional entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, illegible, or corrupted will be disqualified. In case of a dispute over the identity of an entrant who made a potentially winning entry, contest sponsors reserve the right, in their sole discretion, to deem that the entry was made by the registered subscriber of the email address submitted at the time of entry.

(e) Contest sponsors reserve the right to disqualify any entrant who tampers with the operation of the Wake Up and Win Contest or website or violates the Official Contest Rules.

(f) Contest sponsors are not responsible for late, lost, stolen, misdirected, misaddressed, incomplete, or illegible entries. Contest sponsors are not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, or failed, incomplete, garbled or deleted computer or network transmissions, inability to access any website or online service, or any other error or malfunction.

(g) Employees of KTKA 49 ABC, Free State Communications, LLC, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies, and immediate family members of and persons living in the same household as such employees, are ineligible to enter or win.

(h) Unclaimed or unused prizes will be forfeited. Prizes are non-transferable, non-negotiable, and not redeemable for cash, credit or merchandise. If a prize becomes unavailable for any reason, the contest sponsors reserve the right to substitute a prize of comparable value.

5. Entries property of KTKA 49 ABC. All entries become the sole property of KTKA 49 ABC and will not be returned. By entering, you agree to abide by these rules, and warrant and represent that your entry is your original work, and you grant to KTKA 49 ABC the right to edit, publish, promote and otherwise use your entry without further permission, notice or compensation.

6. Selection of winners. Each morning KTKA 49 ABC will broadcast a Wake Up and Win announcement during the KTKA Morning News Update between 6:00am and 7:00am Monday through Friday. If you are the first person to call in you win! You will have two KTKA business days to claim your prize at the KTKA Studios located at 2121 SW Chelsea Drive Topeka, Kansas. You must bring two forms of legal identification to verify your date of birth. Decisions of contest sponsors with respect to the Wake Up and Win Contest are final.

7. Notification. The on-air announcement on KTKA will serve as notification to all potential winners.

8. Taxes and expenses. Winners are responsible for all federal, state and local taxes, and each winner will be required to complete an IRS Form W-9. Winners may receive an IRS Form 1099 or equivalent from KTKA-TV. All expenses following receipt and use of prize are the sole responsibility of winner.

9. Odds. Odds of winning depend on the number of eligible entries received.

10. Waiver and release. By participating in the Wake Up and Win Contest, you agree for you and for your heirs, executors, and administrators to:

(a) Release and hold harmless KTKA 49 ABC, Free State Communications, LLC, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies (collectively, "Released Parties") from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, arising from your participation in the Wake Up and Win Contest, or from your acceptance, possession, use, or misuse of the prize or any portion thereof;

(b) Indemnify the Released Parties from any and all liability resulting or arising from the Wake Up and Win Contest.

(c) Acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prizes, including express warranties provided exclusively by the prize supplier that are sent along with the prize;

(d) Be bound by these Official Contest Rules and to waive any right to claim any ambiguity or error in the Official Contest Rules or in the Wake Up and Win Contest itself; and

(e) Be bound by all decisions of the contest sponsors, whose decisions are binding and final.

THE WINNER WILL BE REQUIRED TO SIGN AND RETURN A WINNER'S AGREEMENT, WHICH INCLUDES AN AFFIDAVIT OF ELIGIBILITY AND RELEASE OF LIABILITY, WITHIN 3 DAYS OF NOTIFICATION OF WINNING, OR THE WINNER WILL FORFEIT THE PRIZE. IN CASE OF SUCH FORFEITURE, CONTEST SPONSORS WILL SELECT AN ALTERNATE WINNER BY RANDOM DRAWING.

11. Force Majeure. If the contest sponsors fail to comply with any provision of these Official Contest Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the contest sponsors (excepting compliance with applicable codes and regulations), or other force majeure event, it will not be considered a breach of these Official Contest Rules.

12. Changes in Official Contest Rules and cancellation. The contest sponsors reserve the right to make changes in the Official Contest Rules, which will become effective upon announcement. If, for any reason, the Watch and Win Contest is not capable of running as planned, including by reason of a force majeure event, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failure, the contest sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend the Wake Up and Win Contest.

Track-It Bracket

Winner. The winner will be chosen from all eligible entries. No purchase necessary. One entry per person is permitted for the duration of the contest. Brackets do not have to be fully filled out or correct. The bracket is used as the registration form. The registration part of the bracket does need to be filled out fully to qualify for the drawing.

Prize. The winner will receive a Wii gaming system. The approximate retail value of this prize is $300.00.  Contest sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion.  Unclaimed or unused prizes will be forfeited after 30 days.  Prizes are non-transferable, non-negotiable, and not redeemable for cash, credit or merchandise.

Dunk it, Spin it, Win it

Winner. The winner will be chosen from all eligible entries. No purchase necessary. One entry per person is permitted for the duration of the contest . Multiple entries will be disqualified. An entry is described as a picture or video of a basketball trick with a completed registration form. Incomplete entries will be disqualified. Winner will be chosen by a panel of KTKA employees. Each entry, basketball trick, will be judged on a 1-10 scale, 10 being the best, in three categories - difficulty, presentation and style. The judges scores will be totaled and the entry with the highest score will win. Winner will be contacted on April 6, 2010.

Prize. The winner will receive 2 tickets and “Meet and Greet” passes to the Harlem Globetrotters at the Kansas Expocenter on April 7, 2010. The approximate retail value of this prize is $150.00.  Contest sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion.  Unclaimed or unused prizes will be forfeited after 30 days.  Prizes are non-transferable, non-negotiable, and not redeemable for cash, credit or merchandise.
