"WAKE UP AND WIN" OFFICIAL CONTEST RULES
1. No purchase is necessary to enter. To participate in the contest, watch KTKA Morning News Update between 6:00am and 7:00am Monday through Friday for your chance to win. Each morning KTKA 49 ABC will broadcast a Wake Up and Win announcement during the above referenced newscasts, if you are the first to call in you win! You will have two KTKA business days to claim your prize at the KTKA Studios located at 2121 SW Chelsea Drive Topeka, Kansas. You must bring two forms of legal identification to verify your date of birth.
2. Contest period. The duration of the contest is from Monday December 29th , 2008 through Friday December 25th , 2009.
3. Prizes. There will be one prize awarded per newscast. The approximate retail value of this prize is $10.00. Contest sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion.
4. Limitations.
(a) Void where prohibited. You must reside in KTKA 49 ABC’s viewing area and be at least 18 years of age to enter.
(b) Your entry constitutes your permission (except where prohibited by law) to use your name, city, state, likeness, image, and voice for purposes of advertising, promotion, and publicity without additional compensation.
(c) Viewers are eligible to win a KTKA 49 ABC contest only once every 60 days. Only one winner per household is permitted in any contest. Viewers are eligible to win a prize valued at $600.00 or more only once every six months.
(d) Only one entry per person for the duration of the contest period. Multiple entries received from any person or email address beyond this limit will void any additional entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, illegible, or corrupted will be disqualified. In case of a dispute over the identity of an entrant who made a potentially winning entry, contest sponsors reserve the right, in their sole discretion, to deem that the entry was made by the registered subscriber of the email address submitted at the time of entry.
(e) Contest sponsors reserve the right to disqualify any entrant who tampers with the operation of the Wake Up and Win Contest or website or violates the Official Contest Rules.
(f) Contest sponsors are not responsible for late, lost, stolen, misdirected, misaddressed, incomplete, or illegible entries. Contest sponsors are not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, or failed, incomplete, garbled or deleted computer or network transmissions, inability to access any website or online service, or any other error or malfunction.
(g) Employees of KTKA 49 ABC, Free State Communications, LLC, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies, and immediate family members of and persons living in the same household as such employees, are ineligible to enter or win.
(h) Unclaimed or unused prizes will be forfeited. Prizes are non-transferable, non-negotiable, and not redeemable for cash, credit or merchandise. If a prize becomes unavailable for any reason, the contest sponsors reserve the right to substitute a prize of comparable value.
5. Entries property of KTKA 49 ABC. All entries become the sole property of KTKA 49 ABC and will not be returned. By entering, you agree to abide by these rules, and warrant and represent that your entry is your original work, and you grant to KTKA 49 ABC the right to edit, publish, promote and otherwise use your entry without further permission, notice or compensation.
6. Selection of winners. Each morning KTKA 49 ABC will broadcast a Wake Up and Win announcement during the KTKA Morning News Update between 6:00am and 7:00am Monday through Friday. If you are the first person to call in you win! You will have two KTKA business days to claim your prize at the KTKA Studios located at 2121 SW Chelsea Drive Topeka, Kansas. 7. Notification. The on-air announcement on KTKA will serve as notification to all potential winners.
8. Taxes and expenses. Winners are responsible for all federal, state and local taxes, and each winner will be required to complete an IRS Form W-9. Winners may receive an IRS Form 1099 or equivalent from KTKA-TV. All expenses following receipt and use of prize are the sole responsibility of winner.
9. Odds. Odds of winning depend on the number of eligible entries received.
10. Waiver and release. By participating in the Wake Up and Win Contest, you agree for you and for your heirs, executors, and administrators to:
(a) Release and hold harmless KTKA 49 ABC, Free State Communications, LLC, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies (collectively, "Released Parties") from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, arising from your participation in the Wake Up and Win Contest, or from your acceptance, possession, use, or misuse of the prize or any portion thereof;
(b) Indemnify the Released Parties from any and all liability resulting or arising from the Wake Up and Win Contest.
(c) Acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prizes, including express warranties provided exclusively by the prize supplier that are sent along with the prize;
(d) Be bound by these Official Contest Rules and to waive any right to claim any ambiguity or error in the Official Contest Rules or in the Wake Up and Win Contest itself; and
(e) Be bound by all decisions of the contest sponsors, whose decisions are binding and final.
THE WINNER WILL BE REQUIRED TO SIGN AND RETURN A WINNER’S AGREEMENT, WHICH INCLUDES AN AFFIDAVIT OF ELIGIBILITY AND RELEASE OF LIABILITY, WITHIN 3 DAYS OF NOTIFICATION OF WINNING, OR THE WINNER WILL FORFEIT THE PRIZE. IN CASE OF SUCH FORFEITURE, CONTEST SPONSORS WILL SELECT AN ALTERNATE WINNER BY RANDOM DRAWING.
11. Force Majeure. If the contest sponsors fail to comply with any provision of these Official Contest Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the contest sponsors (excepting compliance with applicable codes and regulations), or other force majeure event, it will not be considered a breach of these Official Contest Rules.
12. Changes in Official Contest Rules and cancellation. The contest sponsors reserve the right to make changes in the Official Contest Rules, which will become effective upon announcement. If, for any reason, the Watch and Win Contest is not capable of running as planned, including by reason of a force majeure event, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failure, the contest sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend the Wake Up and Win Contest.

1st Class Kids Rules
1. No purchase is necessary to enter. To nominate a high school student for the contest, go to the “FIRST CLASS KIDS” link at www.ktka.com and fill out the online entry form. Or, to enter by mail, write your name, complete mailing address, telephone number and age at the top of a document that details the achievements of the nominee (visit ktka.com/firstclasskids for a printable nomination form), and mail in an envelope to: KTKA-TV, First Class Kids, 2121 SW Chelsea Dr. P.O Box 4949, Topeka, Kansas 66614-1756.
2. Contest period. Entries must be received between 12:01 a.m. on September 23, 2008 and 11:59 p.m. on May 11, 2009 Topeka time to be eligible for the First Class Kids contest.
3. Prizes. There will be [1] prize awarded each month: The winning student will (i) be profiled in a news story to be broadcast by KTKA; (ii) a plaque will be awarded to the winning student’s high school in recognition of the winning student’s achievements. The combined approximate retail value of these prizes is $25. In addition, the contest judges will select an overall winner and overall runner-up at the end of the 2008/2009 school year. The overall winner shall receive an additional $1,500 scholarship check, and the overall runner-up shall receive an additional $500 scholarship check. Both scholarship checks shall be provided by the Gage Dental Group, and payable to the university of the student’s choice, The approximate retail value of the overall winner and overall runner up prizes are $1,500 and $500, respectively. Contest sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion.
4. Limitations.
(a) Void where prohibited. You must reside in KTKA-TV’s viewing area and be at least 18 years of age to submit an entry form.
(b) You must be a the parent, legal guardian, teacher, coach or mentor of the nominee in order to enter a nominee.
(c) Eligible candidates must be involved with a school-sponsored activity for grades 9-12 in KTKA’s viewing area.

Entries will undergo an initial screening process whereby nominations will be checked for completeness, eligibility, and adhesion to the spirit of the award. All entries that meet the necessary criteria will be forwarded to an independent judging panel. Judges will meet quarterly and pick three winners for the upcoming quarter, and will meet following the end of the 2008/209 school year to pick the overall winner and overall runner-up. Winners will be selected based on the judges’ subjective valuation of the candidate’s achievement in various measures of citizenship. These criteria may include, but are not limited to excellence in the following areas: Academics, special talent, good character, balanced lifestyle, athletic ability and service to others. Decisions of contest sponsors with respect to the First Class Kids contest are final.
7. Notification. Contest sponsors will make two attempts to notify winners on or about the first of each month at the phone number or email address submitted in the entry form. If contest sponsors are unable to contact a winner within 48 hours of the second attempt, contest sponsors will chose an alternate winner by the same process as the original judging.
8. Taxes and expenses. Winners are responsible for all federal, state and local taxes, and each winner will be required to complete an IRS Form W-9. SUMMER OF FUN – OFFICIAL DRAWING RULES1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. COMPLETION OF REGISTRY NOT REQUIRED. ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID OUTSIDE THE 50 UNITED STATES/DISTRICT OF COLUMBIA, AND WHERE OTHERWISE PROHIBITED. There are two (2) ways to enter: (1) Enter by registering at any participating Taco Bell location (listed below). All entries, whether mailed in or via Taco Bell entry boxes, must be received by 1:30 A.M. C. S. T. on June 24, 2009.
2. Eligible entrants must enter via either the write-in or in-store entry box as described. No limit on number of entries per person during the entry period. Incomplete entries are void. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. No mechanically reproduced, software-generated or other automated multiple entries permitted. KTKA and Taco Bell will not be responsible for incomplete, lost, late, incorrect, misdirected, illegible, damaged or postage-due mail/ entries or for failure to receive entries due to failures of any kind, including, without limitation, any human error, lost/delayed mail transmission, or any other error or malfunction. All entries become the property of KTKA and Taco Bell and will not be acknowledged or returned. Any questions regarding the number of entries submitted, or otherwise related to the sweepstakes, shall be determined by KTKA and Taco Bell in its sole, reasonable discretion, and KTKA and Taco Bell reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the drawing.
3. ELIGIBILITY: Drawing open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older at time of entry. Drawing is not open to employees of KTKA and Taco Bell and the immediate family members of, and any persons domiciled with, such employees. Entrants agree that all claims in connection with this sweepstakes shall be subject to U.S. law, and adjudicated in the state of Kansas. Void outside the 50 United States and the District of Columbia and where prohibited. Any violation of these rules may result in disqualification. KTKA and Taco Bell is not responsible for errors in the administration or fulfillment of this sweepstakes, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this promotion based upon such error at its sole discretion without liability. Winner agrees that KTKA and Taco Bell, their affiliates and their agencies and employees shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion or from any acceptance or use of any prize awarded.
4. PRIZES: One (1) Grand Prize winner will receive four general admission tickets to Worlds of Fun and a $50 gas voucher, valued at $213. One (1) Second Prize winner will receive $20 in Taco Bell gift certificates, valued at $20. Odds of winning depend on number of eligible entries received. All decisions of judges are final and binding in all respects. Income and other taxes, if any, are the sole responsibility of the winner.
5. WINNER NOTIFICATION AND ACCEPTANCE: Two Potential (1) prize winners will be selected in a random drawing from among all eligible entries to be held on or about June 26, 2009. Potential winner will be notified by e-mail or telephone. If Potential Winner cannot be contacted, does not respond within five (5) days, or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to any prize, and an alternate winner may be selected. Winner may waive their right to receive a prize. Prize is non assignable and nontransferable. No substitutions allowed, except that prize and individual components of prize package is subject to availability and KTKA and Taco Bell reserves the right to substitute prize of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on prizes. Potential winner may be required to sign an affidavit of eligibility (including social security number)/liability and publicity release (except where prohibited by law), which must be returned within 14 days of the date of notification. Failure to sign and return the affidavit or release within 14 days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of KTKA and Taco Bell, result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of prize to an alternate winner. Except where prohibited, participation in the drawing constitutes entrant's consent to the publication of his or her name and image in any media for any commercial or promotional purpose, without limitation or further compensation.
