KTKA/Taco Bell official contest rules

You could win four tickets to Worlds of Fun or Oceans of Fun, gas vouchers or a Taco Bell gift certificates! No purchase is necessary to enter.

1. How to enter : To participate in the contest there are two (2) ways to enter: 1. Enter by registering at any participating Taco Bell location (listed below) or 2. Enter by mail by printing your name, address, e-mail address (optional), the name of the prize drawing and daytime telephone number on a 3.5” x 5” to 4.25” x 6” post card and mailing it to:

   Winners will be determined in three separate drawings.

2. Contest period: Entries must be received between 12:01 AM (CST) on June 2, 2008 and will close at 1:30 AM (CST) on August 15, 2008. All entries whether mailed in or via Taco Bell entry boxes, must be received by 1:30 AM (CST) on August 15, 2008. The windows of each individual drawing are as follows: Phase 1: June 9 – June 20, 2008; Phase 2: June 21 – July 18, 2008; Phase 3: July 19 – August 15, 2008.
3. Prizes: Two (2) Grand Prize winners will receive four (4) general admission tickets to Worlds of Fun and a $50 gas voucher, valued at $206; One (1) Grand Prize winner will receive four (4) general admission tickets to Oceans of Fun and a $50 gas voucher, valued at $162; Three (3) Second Prize winners will receive $20 in Taco Bell gift certificates, valued at $20. Contest sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion.
4. Limitations: (a) Void outside the 50 United States/District of Columbia and where otherwise prohibited. Drawing open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older. (b) Your entry constitutes your permission (except where prohibited by law) to use your name, city, state, likeness, image, and voice for purposes of advertising, promotion, and publicity without additional compensation. (c) Eligible entrants must enter via either the write-in or in-store entry box as described. No limit on number of entries per person during the entry period. No mechanically reproduced, software generated or other automated multiple entries permitted. Entries that are incomplete, illegible, or corrupted will be disqualified. In case of a dispute over the identity of an entrant who made a potentially winning entry, contest sponsors reserve the right, in their sole discretion, to deem that the entry was made by the registered subscriber of the email address submitted at the time of entry. (d) Contest sponsors reserve the right to disqualify any entrant who tampers with the operation of the KTKA & Taco Bell Giveaway Summer of Fun 2008 or violates the Official Contest Rules. (e) Contest sponsors are not responsible for late, lost, stolen, misdirected, misaddressed, incomplete, or illegible entries. Contest sponsors are not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, or failed, incomplete, garbled or deleted computer or network transmissions, inability to access any website or online service, or any other error or malfunction. (f) Employees of Taco Bell, KTKA-TV, Free State Communications, LLC, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies, and immediate family members of and persons living in the same household as such employees, are ineligible to enter or win. (g) Unclaimed or unused prizes will be forfeited. Prizes are non-transferable, non-negotiable, and not redeemable for cash, credit or merchandise. If a prize becomes unavailable for any reason, the contest sponsors reserve the right to substitute a prize of comparable value. 5. Entries property of KTKA-TV: All entries become the sole property of KTKA-TV and will not be returned. By entering, you agree to abide by these rules, and warrant and represent that your entry is your original work, and if you are chosen as a winner, you grant to KTKA-TV the right to edit, publish, promote and otherwise use your name without further permission, notice or compensation.
6. Selection of winners: Six (6) potential prize winners will be selected in random drawings from all eligible entries. Winners will be selected by random drawing on or about June 27, 2008, July 25, 2008 and August 25, 2008. Decisions of contest sponsors with respect to the Summer of Fun 2008 are final. For prize winner list send a self-addressed, stamped envelope to:

   after August 25, 2008 but before September 30, 2008.
7. Notification: Potential winner will be notified by e-mail or telephone at the phone number or email address submitted in the entry form. If potential winner cannot be contacted, does not respond within five (5) days, or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to any prize and an alternate winner may be selected. Prize is non assignable and non transferable.
8. Taxes and expenses: Winners are responsible for all federal, state and local taxes, and each winner will be required to complete an IRS Form W-9. Winners may receive an IRS Form 1099 or equivalent from KTKA-TV. All expenses following receipt and use of prize are the sole responsibility of winner.
9. Privacy Policy and Terms of Use Agreement: By entering the KTKA & Taco Bell Giveaway Summer of Fun 2008 on the www.ktka.com website, you agree the use of your personal information as described in the Privacy Policy and Terms of Use Agreement on the www.ktka.com Web site.
10. Odds: Odds of winning depend on the number of eligible entries received.
11. Waiver and release: By entering the KTKA & Taco Bell Giveaway Summer of Fun 2008, you agree for you and for your heirs, executors, and administrators to: (a) Release and hold harmless KTKA-TV, Free State Communications, LLC, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies (collectively, "Released Parties") from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, arising from your participation in the KTKA & Taco Bell Giveaway Summer of Fun 2008, or from your acceptance, possession, use, or misuse of the prize or any portion thereof; (b) Indemnify the Released Parties from any and all liability resulting or arising from the KTKA & Taco Bell Giveaway Summer of Fun 2008, (c) Acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prizes, including express warranties provided exclusively by the prize supplier that are sent along with the prize; (d) Be bound by these Official Contest Rules and to waive any right to claim any ambiguity or error in the Official Contest Rules or in the KTKA & Taco Bell Giveaway Summer of Fun 2008 itself; and (e) Be bound by all decisions of the contest sponsors, whose decisions are binding and final. THE WINNER WILL BE REQUIRED TO SIGN AND RETURN A WINNER’S AGREEMENT, WHICH INCLUDES AN AFFIDAVIT OF ELIGIBILITY AND RELEASE OF LIABILITY, WITHIN 3 DAYS OF NOTIFICATION OF WINNING, OR THE WINNER WILL FORFEIT THE PRIZE. IN CASE OF SUCH FORFEITURE, CONTEST SPONSORS WILL SELECT AN ALTERNATE WINNER BY RANDOM DRAWING.
12. Force Majeure: If the contest sponsors fail to comply with any provision of these Official Contest Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the contest sponsors (excepting compliance with applicable codes and regulations), or other force majeure event, it will not be considered a breach of these Official Contest Rules.
13. Changes in Official Contest Rules and cancellation: The contest sponsors reserve the right to make changes in the Official Contest Rules, which will become effective upon announcement. If, for any reason, the KTKA & Taco Bell Giveaway Summer of Fun 2008 is not capable of running as planned, including by reason of a force majeure event, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failure, the contest sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend the KTKA & Taco Bell Giveaway Summer of Fun 2008.
