Convicted sex offender violates probation

I obtained court documents which indicate Cisneros tested positive for marijuana only five days after being placed on probation.
Then, after verbal warnings and counseling, his probation officer indicates he tested positive again 41 days later.
Both are violations of his probation.
A warrant was issued for his arrest and Monday he turned himself in.
Some say it proves the judge made a mistake by letting him walk free.
Michael Burlison hasn't sat quiet ever since Judge Matthew Dowd sentenced Cisneros to probation for repeatedly raping Burlison's 14-year-old daughter.
Now that Orlando Cisneros has been arrested for violating the terms of that probation, Burlison says it just proves the judge made a stupid mistake.
"It's being proved out in a relatively short amount of time, the lack of intelligence in making that decision," Burlison said.
Tanya West has also been actively interested in the case. Cisneros fathered her two children and ever since the judge let him walk free, he's tried to gain custody of those kids.
It was in court last month where West testified she witnessed Cisneros inappropriately kiss the children with his tongue. And now, she's afraid Judge Dowd will let him walk free again.
"He let him go the first time, now he's probably just going to do it again. Just a slap on the hand, that's all it is," West said.
On August 3, Cisneros will get the chance to prove he didn't violate the terms of his probation. If he doesn't, the judge has several options.
First, Judge Dowd can send Cisneros to prison for 13 years. The Shawnee County District Attorney says this is what he desires.
But the judge can also leave Cisneros on probation. Local attorney John Bryan tells me it's a possibility if Judge Dowd doesn't want to give in to public pressure.
The judge could also modify the terms of his sentence.
Nonetheless, District Attorney Hecht says it proves a man charged with 20 felony sex crimes is not a good candidate for probation.

Stop letting Judge Dowd make a mockery of the Kansas criminal justice system. Abortionist quack George Tiller does enough of that already. Get Dowd off the bench.

The ‘rights’ of the abuser; have always surpassed the rights of the victims’. The Judge is allowed to make these decisions as there is no public outrage to change the quasi ‘Judicial Immunity’ of these ‘protected’ gods that wear black cloaks.

They allow child rapists back on the street, to rape again. Now in regards to Cisneros getting out Aug 3rd, so that he can ‘make his family law court hearing’. 10 to 1.... he will.

I am from Topeka Kansas; and the lead Plaintiff at the ‘Inter American Commission Human Rights’ suit filed just before mothers day, as a Shawnee County Court, victim and survivor- addressing these issues directly. Kansas State is hard copy ‘signor’ to petition as well.

Judges fail time and time again to protect the children; the rights of the victim are meaningless to those rights of the rapists/abusers ESPECIALLY when they seek, they WILL get those ‘rights’, over what is truly the best interest of the children, and to society as a whole.

…nor should it be an alternative, to access for these rapists and abusers to continue to commit ‘allowable crimes’ to our children.

The only qualifications’ to be a supervisor at ‘Safe Visit’ Topeka KS is a valid DL, a H.S diploma or equivalent. Tell ya anything…???

People need to be apprised of what is going on truly in the Courts…. With out that knowledge then the Courts will time and time again fail the victims’ and we are many!!

Courts are awarding abusers and rapists custody of the children they seek… 70% who seek custody will be given custody. This is all verifiable through were the petition is posted. It seems that the more extensive the ‘record’ the more the ‘courts’ want to ‘fix’ or ‘favor’ the perp. and HIS ‘rights’, not the victims..

This is not about Dowd giving into public pressure, this is about doing the right thing at the right time. This is about protecting the children, and insuring that those that violate children are put away at the maximum extent of the law, which is not being upheld here.
Cisneros obviously is not a good candidate for probation not only for his 20 FELONY Sex offenses against a child, but also because he obviously has very little regard for the law and his probation if he is not able to abstain from drugs while on probation, much less 5 days in.
Unfortunately, this is not the only child rapist that Dowd and other Judges in Shawnee Co. have let off easy, and it is the public and Topeka, and more importantly the children that pay the price, not them.

The public needs to open their eyes, more importantly, the Judges need to come to their senses and do the right thing, and protect the children.
As for Cisneros, I pray that he does not get out, and that justice is held for his victim, but also for the children that he wants to gain custody of. Does a child rapist, a man with 20 FELONY Convictions, very little regard for the law and a pot addict deserve time with his children? Yet, he is being allowed to put his X and the children through strain and fight for them. The same children that he has reportedly groomed? This needs to end, and the only way to do it is for Topeka to stand up and let the Judges, and mostly Judge Dowd know that this is not acceptable. Rapists should NOT walk the streets, and Topeka should NOT fear for the safety of their children. Innocent Children should NOT have to pay the price of their mistakes...

MOTHERS FILE INTERNATIONAL COMPLAINT AGAINST UNITED STATES
Mother’s day complaint claims United States courts violate human rights of abused women and children.
NEW YORK, On May 11, just before Mother’s Day weekend, ten mothers, one victimized child, now an adult, leading national and state organizations filed a complaint against the United States with the Inter American Commission on Human Rights.
The case claims that U.S. courts, by frequently awarding child custody to abusers and child molesters, has failed to protect the life, liberties, security and other human rights of abused mothers and their children.
The complaint details several cases with documented medical evidence of child sexual abuse, yet in each instance the father who was accused of abuse was given full custody of the children. Several of the mothers were jailed by the courts because of their persistent efforts to protect their children from abuse, several were ordered not to speak of the abuse and not to report abuse to authorities.
Every mother was denied contact with her child for some period of time though none was ever proven to have harmed them.
"My life was completely shattered apart on that day and my childhood was destroyed," said Jeff Hoverson, the adult child petitioner, about the day a family court judge ordered sheriff deputies to deliver him into the custody of his abuser. "It was as if I was just kidnapped. I was torn from everything I knew....I was made into a possession rather than a child." Hoverson endured years of trauma and fear living in his father's home before escaping and returning to his mother at age 17. He is haunted by years of feeling helpless to prevent his father's night-time visits to his sisters’ bedrooms.

Since this man has ALREADY been PROVEN to be a child rapist and drug addict, he should AUTOMATICALLY get his rights as a father REMOVED! He is UNFIT!
I have been raped as a child AND as an adult and BELIEVE me, there is NO excuse for going "light" on people like THIS! QUIT making a mockery of the court system in GENERAL and SHOW this country and the WORLD that child rapists SHOULD PAY FOR THEIR CRIMES, NO MATTER THE CONSEQUENCES! To do otherwise, demeans EVERYTHING this country stands for!

This judge needs to be debenched. And pronto. His first ruling shows how incompetent he is in setting sentences. To let a rapist, be it a child rapist or adult, go free with just slap on the hand is exasperating. Justice has not prevailed by this man, it just says to others that you can do anything you want to and get probation. I pray that the Juvenile Courts sees this man as a threat to his children and the childrens mother. I pray for justice of the little girl whom now must watch her back where ever she may go. This community voted this Judge into the seat and they can demand he be taken down. This community deserves the right to sleep peaceful at night and not fear another rape by this so called parole violator.

How will this effect the appeal to the original sentencing? One would think it would help. But with judges like Dowd, it might have no bearing. Not only should Dowd pay attention to the public outcry. But also to the fact that Cisneros is a low life who has shown through his actions, that he feels he is above the consequences of breaking the law. It's not about bowing to public pressure - its about following the laws and doing the right thing. Dowd repeatedly disregarded the victim's rights & well being as well as those of the public. Cisneros probation needs to be permenently REVOKED. Cisneros belongs in prison!!!
