Some Topeka residents own Houses from Hell

Drugs. Prostitution. Arson. And to top that off, infestations of rats. All can make living in the Capital City miserable and even dangerous. What do all these deplorable conditions have in common? They are all complaints of residents of one Topeka management company.

"We've seen cars pull up, leave the engine running, leave the doors open," said Central Park neighbor Colin Bennett.

"In the hallways or other areas they find things like used condoms," said Ginger Bennett.

Keith Holden and Jennie Fike have lived in the apartments at 1019 Douthitt for six months. Those apartments are owned by Duc1.

They say trash is a normal part of life here at the apartments. Neighbors say a dirty yard is the least of their problems.

"There was evidence of cocaine being used," said Colin. "There was also evidence of marijuana. So, we know there's some drug activity going on."

Bennett and his wife, Ginger, live in Central Park neighborhood and have seen much of this activity with their own eyes.

When asked do you think there was prostitution going on, Ginger replied, "that's what I was thinking from the way they were dressed."

The police have seen their share of criminal activity at 10th and Douthitt. 49 News did some digging and got a hold of these police reports. According to reports, Topeka Police have been called to the Douthitt apartments at least 30 times in the past two years for everything from cocaine possession and domestic battery to theft and criminal damage.

Claude Duncan is a hard man to reach, but 49 News' Liz Zamora tracked him down. When confronted with what neighbors said about his operation, he said there was no way he was going on camera.

He did say though if someone was doing something illegal and he could prove it, he would kick them out.

Neighbors believe 30 police reports is proof enough.

Longtime Central Park resident Don Perkins says the apartment weren't always this bad. He said after Dunc1 took over it's kind of went down hill.

"There's been a lot of drugs and criminal activity in this building," Perkins said.

In the Old Town neighborhood 49 news took a look at a different property and came up with the same problems.

"We've had some vandalism, car break-ins" said one property manager.

"We've seen multiple cars pull up. Somebody runs out of the house after the horns been honked," said another property owner "Run out, lean in, -- they're there for 15-20 seconds.

The property owner doesn't want to be identified because of fear of retaliation.

"People in the drug industry don't like people blowing whistles at them," he said.

But another property manager said landlords couldn't be responsible for the actions of their tenants and believes property managers like Dunc1 perform a service for other landlords.

"If we evict everyone who causes problems, I mean as an industry, where are they going to live?" Perkins said. "I don't buy that at all because I know everybody needs a place to stay, and you got to treat people humane. But, at the same time, you gotta decide what kind of tenants you want."

And if there's no crime, chances are the mess makes it a House from Hell.

When someone moves out, their stuff stays behind - some for nearly two months.

49 News was given pictures of piles of garbage in the Highcrest neighborhood. People simply left piles of stuff behind, and neighbors were forced to look at it.

"Some people call it the slums," said Highcrest neighborhood resident Karen Snyder. "I never wanted to live in the slums."

And, when the people in the neighborhood move out, not everyone follows.

Linda Cercone and her son Christopher said the house they lived in was infested with mice, rats and snakes.

"You go to bed at night, you have mice crawling all across you," she said.

Christopher Munro says "and all of a sudden you'd hear ch-ch-ch all around you, and it would be the rats and mice chewing."

Duncan says anytime a problem comes up, he addresses the issue.

49 News checked with the city's Code Compliance Department on code violations, and the reports say every issue has been resolved.

If the tenants are doing something illegal, arrest them, put them in jail. Since when are landlords law enforcement, judge and jury?

If you rent a car, and wreck it or run over someone, is the car rental agency resposible? Are all the fast food restuarants responsible for litter that people throw from their cars?

People are responsible for their own actions, make them accountable and don't blame others. The frustration of neighbors leads to feel good laws that do little good.

some lanlords dont care at all who is living inside their dump as long as they are getting paid. they dont care what the house looks like on the outside or the inside. how do you think you can be a judge and a jury if you cant even keep the houses you buy and rent out nice to live in. i would blame the lanlord if he doesn't screen tenants first. why wouldn't you. i would want someone in there that is not going to tear it up and be able to pay on time every month. lanlords are also responsible for there houses they buy. if tenants are always getting the neighbors to call and complain then the lanlord needs to kick them out. lanlords need to set rules for there houses and if the rules are broken then they need to kick them out.

I agree with both anonymous comments above. We should have stricter code enforcement law agaist tenants. Should a tenant be aloud to trash the inside and outside of houses? Why are only landlords being punished? Landlords are required to follow the Kansas landlord tenant law.

In reguards to tenant screening. Every landlord dreams of having good renters. Who wouldn't? All the screening in the world doesn't stop properties being trashed in as little as 30 days.

I would like to comment on KTKA 49 "HOUSES FROM HELL SERIES". Liz did a wonderful job. It should also be noted. The renter that had snakes, mice, and rats. She had been evicted twice in the last ten years. She was also the plainteff in a small claims action agaist Mr. Duncan. She lost. Here is the address to shawnee county website:

Perhaps if the people living in the houses took a day off from, drinking them selves senseless, selling crack, making meth, and fornicating, and whatever else; and cleaned up the house ( sorry "crib") maybe the rodients wouldnt have anything to feast on? I bet none of the tenants took that into consideration, if they did it might make them look less like a victim.

If dunc 1 would take care of there rental houses, people wouldn't complain. It is the lanlords responsability to fix the house up before someone moves in. Don't blame the tenants for problems that were there before they got there. It is the landlords responsability to keep up the house while people live there, thats why they are called landlords. If you really knew how dunc 1 works, you wouldn't be taking his side. I have heard so many stories from people that lived in dunc 1 houses. Everything from high rent, leaks in the roofs, and pipes and even moldy walls. There was even reports from Westar Energy that when he did have people fixing things in empty houses, his "workers" cutt of the end of an extension cord, and tied the wires to a power line. I am no law expert, but I am sure that was stealing electricity from westar. Its really sad to see all of these people above me siding with dunc 1, and calling the tenant bad people. I have one question for all of you that have posted before me. Have you met any of the tenants? My guess is that you haven't. Just because most of the houses dunc 1 has are in a not so good area of town, don't put a label on the people living in those houses. If you really knew what was going on, you wouldn't be saying those things about the tenants. So next time you post something like this, take a minute to find out who these people are, and you will side with them, instead of a slum lord.
