Judge gives new life to Topeka parking lot battle
4:57 p.m. Friday, February 1, 2008
The Friends of Bethany Place will get its day in court, a district judge said this afternoon.
The group filed a lawsuit against the City of Topeka to prevent a parking lot from being built near Grace Cathedral.
The group believes the site has historical value and should be preserved.
The city filed an appeal, which Judge Franklin Theis denied. He also made the Kansas Episcopal Diocese part of the lawsuit.
The next hearing will be May 2 at 1:30 p.m.
The trees at the location have already been cut down; the Friends of Bethany Place are fighting to prevent the area being paved.
